11.1. Purpose and Scope of Data Processing:
The Service Provider uses artificial intelligence (AI) technology on its website to quickly respond to visitors' needs and inquiries:
– AI Chatbot: Responding in real time to messages submitted by visitors and providing general information. Data processed: the text of the conversation, the time of the inquiry, and browsing metadata.
– AI Form and Audit Processing: Preliminary technical analysis of audit requests and requests for proposals submitted via the website. Data processed: name, email address, website URL, and a description of the business needs provided.
11.2. Legal basis for data processing:
– In the case of inquiries, requests for quotes, and audit requests: Article 6(1)(b) of the GDPR—taking steps prior to entering into a contract at the request of the data subject.
– For general visitor chatbot communications: Article 6(1)(f) of the GDPR—the Data Controller’s legitimate interest in ensuring 24/7 customer service availability.
11.3. Absence of automated decision-making and profiling (Article 22 of the GDPR):
The Service Provider does not use any automated decision-making or profiling that would have legal effects on the user or significantly affect him or her. AI technologies are used solely for preliminary data preparation and making recommendations; the actual price quote and the conclusion of the contract are always approved by a human professional (the Data Controller).
11.4. Third-Party AI Data Processors Used:
To operate its AI features, the Data Controller uses the following international technology partners:
– OpenAI, LLC (3180 18th Street, San Francisco, CA 94110, USA) – Provides large language models (LLMs) via an API. Data transfer in accordance with the EU-US Data Privacy Framework (DPF) and the Standard Contractual Clauses (SCCs) adopted by the European Commission.
– Anthropic, PBC (548 Market St, PMB 99014, San Francisco, CA 94104, USA) – Analytical models (Claude API). Data transmission based on DPF and SCC.
– n8n GmbH (Hans-Sachs-Straße 12, 14469 Potsdam, Germany) – Workflow automation and data connectivity (using infrastructure within the EU).
11.5. Guarantee of Data Protection (Exclusion of Model Retraining):
The Service Provider uses the official, paid enterprise API interfaces of the above AI partners. In accordance with the providers’ terms and conditions, the data and messages you provide will be processed by the providers They do NOT use it for developing, fine-tuning, or training artificial intelligence models.
11.6. Transparency Information (Article 50 of the EU AI Act):
